Wednesday, October 1, 1834. James Hoyle, Richard Allen, Henry Walker and Thomas Burrell were placed at the bar - the three first charged with stealing, on the 20th of April last, two oxen the property of Michael Lackey; and the prisoner Thomas Burrell was charged with receiving the same knowing them to have been stolen. Robert Warburton examined - Resides at the prisoner Burrell's; recollects going up to Mr Kemp's Lakes about a month or six weeks ago; went there for the purpose of collecting some cattle for Burrell; the cows witness brought down, were killed at Pitt's yard; there was a young steer and a black cow; the skin of one of them witness brought home and cut up for ropes; the prisoner Allen was present when witness got the carcasses; witness told his master he had brought a black cow and steer; told him, also, he could not get in a bullock called Tinker. James Frome examined - Saw the prisoners Walker and Allen in Kemp's paddock in July last; witness assisted them to collect some cattle; when witness saw the cattle in the yard he knew them to be Mr Lackey's; there was a black cow and a dark brown steer; they were driven by Allen and a man named Stamford, in Pitt's yard; witness did not mention his knowledge that the cattle belonged to Mr Lackey; witness assisted to kill them; the brands were cut off the hides by the prisoner Hoyle, who took away one of the hides. Stephen Stamford examined - Saw the prisoners Allen and Walker at Mr Kemp's hut in June last; the prisoner Hoyle was overseer; Allen and witness went to Mr Kemp's Lakes to collect some cattle for Burrell, but could not find them; Hoyle told witness to take six head of cattle to Pitt's yard, as he wanted to have three of them killed, two for Burrell and one for Walker; they were killed; two of the hides were afterwards cut up for ropes. Cross-examined - Witness believed, when he assisted to kill the cattle, that they belonged to James Hoyle; Hoyle told witness they were his property. Mr M Lackey examined - Resides at Bagdad; has a large quantity of cattle running at Mr Kemp's Lakes; saw a hide at Bothwell upon which there was part of a brand; cannot swear the hide was witness's property. Cross-examined - The Lakes are so extensive that it is impossible to say whether he has lost any or not; has only sold one bullock for the last two years. Michael Roberts examined - Is stock-keeper to Mr Lackey; missed some cattle belonging to his master when collecting steers for work; missed a brown steer and a black one with a white back. William Edwards examined - Is a constable; the hide produced witness found on the 21st August last, concealed under an old dead tree near Pitt's yard. James Frome recalled - Accompanied constable Edwards to Pitt's yard, and found a hide concealed near the yard. Maurice Roberts recalled - Missed the steers in question in June last; they were worth about £10. Cross-examined - Missed the steers in June in consequence of collecting the steers for work in the ploughing season; all the cattle were not collected in June; in cold wet seasons a great number of cattle die at the Lakes; witness missed several besides the two steers in question; witness branded the steers himself; they were between five and six years old; they had been at the Lakes two years and a-half; witness saw them a day and a-half before they were missed; they may have strayed across the Lakes. This was the case for the prosecution. Mr Gellibrand submitted that there was no evidence against Burrell to go to the Jury, His Honor said he thought there was. The prisoner Hoyle was then called upon for his defence - he said he was innocent, as did, also, the other prisoners. The Jury returned for a short time and found all the prisoners not guilty.

DEATH OF AN OLD COLONIST. On Saturday last (writes our Bothwell correspondent) Mr Richard Allen, senior, quietly passed over to the great majority at the ripe age of 82, and was this day (Tuesday) followed to his last resting place in the Church of England burying ground by a large concourse of old friends, who thus showed the esteem in which he was held by those who knew him. Mr Allen may well be ranked amongst the old colonists, and as one of the pioneers of the colony, for he arrived here in the year 1821. Shortly after his arrival he took up his abode in this district, where he purchased a farm upon which by industry and straight forward dealings with all his neighbours he was enabled to lay aside sufficient to support him in the declining year of his life. Mr Allen was a widower, having buried his wife some 16 years ago. He had 14 children, eight of whom are still living and fairly well provided for.
