CAUGHT IN THE ACT. Charles Harvey, alias Silas Tucker, was remanded to Bothwell for examination there on a charge of obtaining money under false pretences from Mr Edward Andrews, of Bothwell. It appeared that Harvey happened to know that a friend of Mr Andrews was expected in Launceston from New Zealand, and he thought it was a good opportunity to raise the wind. He accordingly wrote a letter to Mr Andrews, requesting a sum of £65 to be sent to him (Mr Lewis), addressed care of Mr Harvey. Mr Lewis from New Zealand, happened to be at Bothwell at the time the letter from Harvey arrived, and of course Mr Andrews represented the case to the district constable, who advised him to send a one pound note in the manner requested, and he (the district Constable) would go to Launceston by the coach and entrap the aforesaid Harvey. On arriving at Launceston, the District Constable of Bothwell went to the post office with two or three constables, and presently Harvey came and enquired for a money letter for Harvey. On being told there was one, he went in and signed the book, when he was apprehended and taken before the magistrate. (10)

QUARTER SESSIONS, OATLANDS. A man named Silas Tucker was charged with obtaining money under false pretences. This trial was the most interesting during the day. It appears Tucker had been in service at Launceston, after a former service at Bothwell. He wrote a letter from Launceston addressed to Mr Andrews, of Bothwell, purporting to have been written by a person named Charles Lewis, for many years a resident of Bothwell, and who has been for some time past in the habit of visiting Port Phillip occasionally, and other places. The prisoner thought Lewis was out of the colony at the time, and wrote to Andrews stating that he had just returned from New Zealand, and had a quantity of notes, cheques, or bills with him, which were payable at Hobart Town. He stated he did not wish to submit to the exorbitant discount chargeable at Launceston, and would thank Andrews to send him (as C Lewis) £70 or £80 as he was going to ship a quantity of flour, &c, to New Zealand. As Lewis was at the very time in Bothwell, Andrews communicated with the police, and it was arranged that an answer should be sent as directed to the Post-office, at Launceston, and that it should be marked as a money-letter. The Chief District Constable of Bothwell took the mail on the same night the letter went, and reported the circumstance to the post-office authorities at Launceston, who in the usual manner sent a notification to the residence of Tucker, alias Lewis, to inform him that a letter of the kind was lying at the office to his address. The bait took, he went for the letter, gave a receipt for it, and was taken into custody with the letter in his hand. The letter contained a £1 note. The prisoner made a rambling defence, stating that a man had met him and asked him to go for the letter; but the jury convicted him, and he was sentenced to two years imprisonment. (11)

Godfrey McDonald, engine-driver, residing at Clifton Hill, stated that he found the body of the deceased in the Yarra, near Dight's Falls, Collingwood, on the 4th inst. He reported the matter to the police. The body was fully dressed. Constable Nicholson deposed that he recovered the body and removed it to the Morgue. It was very much decomposed. He had made inquiries, and found that deceased had drawn £10 out of the Savings Bank on the 27th June, but witness had been unable to trace what had become of the money. Deceased, who had not been drinking, left his lodgings on the 29th June. Harriet Thompson, dairy-keeper, Clifton Hill, said that deceased, who was sixty-nine years of age, stayed at her place when he came to Melbourne. He left it on the 29th June last. He was sometimes a little strange in his manner, and went to the Hospital, but did not go in as a patient. Two days previous to leaving he had drawn £10 out of the Savings Bank for the purpose of paying a blll. Deceased had about £230 in the bank. He was very much depressed when he left on the 29th June. He had never threatened to take his life, but on one occasion had spoken about it being an easy place to go to Studley Park and roll down the bank into the Yarra. Deceased had a selection near Trawool. Dr Neild, who made a post-mortem examination of the body, deposed that the cause of death was drowning.
