Found not guilty and discharged. Thomas Hand being sworn said - 'I am a Constable attached to the Bothwell Police. On Saturday night last, between 10 and 11 o'clock, I was on duty and going down the street that leads to the Green when I met the prisoner, Joseph Shaw, and another man. I asked them who they were and the prisoner said he was a Ticket of Leave man. I asked in whose service and he said Mr Blake's. I then turned to the other man and asked him who he was and he said he was a Ticket of Leave man and that he was no service at present. Prisoner then said if I wanted any more of him I must go to his master. I told him I knew nothing of his master, he should go with me to prove where he belonged and in turning round the corner, I said "come along my lad", and he said "no, he would go to his master" and ran away into his master's yard and I followed him. He shut the gates and ran to the back of the house and I went and took hold of him and he got hold of a water tube and I pulled him away from that and he then put his legs between my legs and upset me and when I got up still retaining my hold of him, he called out "master," some person came out. I did not know Mr Blake personally and he said I should not take him, prisoner, out of there and attempted to pull prisoner away from me. I told him I would take him and if he restricted me in my duty, I would take him otherwise. Mr Blake then stood between me and prisoner again, threw me down by putting his leg between mine and throwing me off my balance and in going out of the gate, prisoner tried to throw me down again but I told him it would not do this time and he then put both arms round my legs and tried to throw me backwards. I then called another constable and took prisoner to the watch-house and when I got to the watch-house keeper's place, I found it was nearly five minutes to eleven. When prisoner threw me down I had on the police coat now produced and it was damaged in the fall. Prisoner was sober and quiet and was going towards his master's residence. The scuffle lasted ten minutes, it was about a quarter past ten o'clock when I first saw prisoner.' Questioned by prisoner - I took you in charge at Mrs White's corner.
