SARAH (DALWOOD) WILSON. Daughter of Mr James Dalwood, of Stoke, Somerset, is able to recollect from her childhood the slavery imposed on people, who in those now far-off days had to work for a living. Her parents were employed as glovers at Martock, where gloves were made for the fashionable folk of London. The gloves worn by dignitaries at the funeral of the Duke of Wellington were made here - the first, second, and third mourning series - from material sent by the London outfitters, and frequently, Mrs Wilson recollects, her mother had to work until nearly midnight to complete extra orders. She was paid 1s 6d a dozen for making lisle thread gloves, and if the stitches were not sufficiently closely sewn, down came the wages, it was such hard toil that led the Dalwoods to think of emigration, and accordingly in 1853 or 1854, as a child of 13 years, Sarah Dalwood accompanied her parents to Tasmania. They settled at Bothwell, where Mr Dalwood established a timber yard.

WILL DISPUTE. THE PRACTICE COURT. A Family Dispute. In the Practice Court yesterday, before the Chief Justice (Hon H Nicholls), Mr Davenport Hoggins appeared in support of an originating summons seeking the direction and advice of the Court for Orlando Morrisby, trustee of the estate of a family named Dalwood, which consisted of money and Gas Company shares representing approximately £961. The motion had reference to the wills of the late James Dalwood, senior, of Hobart, and of his widow, Mary Dalwood, who recently died in Argyle-street. Mr O Morrisby was the trustee under both wills, and the Court was asked to say whether Mary Dalwood had a power of disposition, inter vivos, by will of the personal estate of her late husband bequeathed to her for her solo benefit during her life; how the debts, funeral and testamentary expenses, were to be paid, the persons to whom the trustee should distribute the estate, and direction as to a claim of £792 made by Mary Currell, a daughter, for nursing and maintenance of the widow, who had been an invalid for many years. Mr Hoggins appeared for the trustee and the children, excepting James Dalwood, the son, for whom Mr Horace Walch (Simmons, Wolfhagen, Simmons and Walch) appeared. Mr Hoggins stated that his clients were prepared to act on the direction and advice of His Honor on the questions raised. Should the estate redistributed in accordance with Mary Dalwood's will, or, in the alternative, must it be distributed between the parties named by her late husband's will? James Dalwood, senior, made his will a long time back, and died 22 years ago. Under his will he left everything to his wife for her life, making no restrictions as to how she was to deal with the estate. On his death the widow transferred everything into her own name, and dealt with the money and shares as her own property. Before her death Mary Dalwood made a will; but there was a difference between the two wills. In the husband's will he left out the name of his eldest daughter, and Mrs Dalwood, in her will, left out the name of the son, James Dalwood. That son lived in Victoria, and had not come near his parents or attended their funerals, having been away 40 years. The widow left the money and shares between the children, but not in the same way as her husband did. The trustee proved Mrs Dalwood's will, and realised on the gas shares, when James Dalwood, the son, and a daughter residing in Melbourne, put in claims, and so he now wanted the direction of the Court as to how he should distribute the money. Mr Walch raised the question whether Mrs Dalwood took a life interest only, or an absolute interest, and he contended that she only took a life interest, with the residue to the children. His Honor: What belonged to Mrs Dalwood passed under her will, and what belonged to the husband passed under his will. Mr Hoggins: But the husband, in his will, did not restrict her as to what she disposed of or spent. After argument, His Honor intimated that he would give judgment next day.

The motion before the court had reference to the will of the late James Dalwood, senior, of Hobart, and the subsequent death of his widow, Mary Dalwood, who recently died in Argyle-street. Dalwood, senior, by his will left the property to his wife with remainder to his children. The widow, in her subsequent will, treated the property as her own and disposed of it differently; and the question was whether she had more than a life interest, and whether the property should, pass to the next-of-kin under the husband's or the widow's will. Mr Davenport Hoggins appeared for Orlando Morrisby, trustee, and the children, excepting James Dalwood, junior, a son, for whom Mr Horace Walch (Simmons, Wolfhagen, Simmons and Walch) appeared. His Honor held that the will of James Dalwood, senior, must be upheld, and that the widow had only a life interest, as contended by Mr Walch for James Dalwood, junior. Mr Hoggins said that when he drew up Mary Dalwood's will, and subsequently lodged it for probate and paid probate duty on it, on behalf of Mr Orlando Morrisby, the trustee, he had no notion of the existence of the husband's will, and so he asked for his Honor's directions as to a refund of the trustee's costs of probate of the widow's will. His Honor thought there should be no difficulty in getting a refund of the duty paid under the widow's will if it was paid under the erroneous belief that the estate belonged to the testatrix. Mr Hoggins asked that the funeral expenses of the widow be paid out to the estate. His Honor said he could not see how he could order them to be paid out of money that did not belong to the widow, excepting for her life. As a matter of decency, the relatives should pay him funeral expenses, but a judge had no power to make an order on the ground of decency. Mr Walch: A lot may be said on the other side. Mrs Rosina Currell, a daughter, is claiming nearly the whole of the estate for nursing and maintenance of the widow, and ought to have those expenses. Mr Hoggins asked his Honor what about the claim of Mrs Currell. His Honor said that if it were a bona-fide claim she could sue in the ordinary way. There was ample authority for that. Mr Walch applied for the costs of his client in the matter, which were allowed.
