CARRYING PASSENGERS WITHOUT A PASS. Margaret Matthews and Mary Jackson were charged by Constable Middleton with misconduct, in being in Brighton without a pass. It appeared the women had been released from the Brickfields Depot on hire to the service of two individuals at Bothwell, and were entrusted to the care of Mr Andrews, the Bothwell carrier, who, from what appeared, had bestowed all the care and control he well could on their journey towards Bothwell; but according to the custom adopted at the Depot, had received no passes with the women. Near Brighton he had occasion to return back a little way, and entrusted his wain to his driver, who had carelessly suffered the women to pass along Brighton without any control. The PM expressed his surprise that the women had no passes, and his intention of writing to the authorities on a measure of prison discipline so necessary to be observed, and discharged the women to the care of Mr Andrews, with a caution, expressing it as his opinion that being unlicensed to carry passengers, he became liable under a Colonial Act of Council, to be fined for breach of that Act, by carrying passengers for hire. Thomas Bishop, ticket-of-leave, in the service of Mr Andrews, before mentioned, was charged by Constable Middleton with resisting him in the execution of his duty. He deposed, that being on duty in the township of Brighton, he saw the prisoner on horseback, and leading one of the before mentioned women by the hand. Finding she was a prisoner, Middleton asked her if she had a pass; she answered "No." He then asked the defendant if she was under his charge, and if he had any authority, to neither of which questions he gave any direct answer. Witness then said she must go to the Chief Constable. Defendant then dared witness to interfere, spurred his horse, and pressed forward, pulling the women with him. Witness then took him and the woman towards the watch-house, on pretense that he would wait for his master. His master soon afterwards arrived, and on defendant being taken to the watch-house, he said he would make it a warning to the constable. The PM, with a most severe reprimand made it a warning to him by fining him £1.
